The proposed European Health Data Space has two problems related to the secondary use of health data. It is not specific about the legal basis and it allows for a broad range of health data uses that carry risks to fundamental rights.
22 March 2023 The European Commission proposed European Health Data Space in 2022. It creates the possibility to use health data for secondary purposes beyond providing health services to individuals. This opens the opportunity to use health data in public interest, such as development of public policy. However, the Commission's draft is imprecise and allows for a broad range of uses that risk fundamental rights.
ICCL has written to the co-legislators about the problems in the European Health Data Space. In a two column document, ICCL makes suggestions on addressing these problems.
